Terms of Service

1. About These Terms

These Terms of Service (“Terms”) are a legal agreement between you and Metro Atlanta Street Hockey Association Inc. (“MASHA,” “we,” “us,” or “our”), whose principal place of business is the Mark Ogden Hockey Rink at Pinckneyville Park in Norcross, GA. They govern your access to and use of our website(s), mobile application, and related online and offline products, services, and experiences (collectively, the “Services”).

By creating an account, registering, or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, and our Liability Waiver. If you do not agree, do not use the Services.

2. Eligibility and Age Requirements

You must be at least 16 years old to register for or participate in MASHA activities and to use the Services. If you are 16 or 17, you may only register and participate with the review and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. By using the Services, you represent that you meet these requirements and that the information you provide is accurate.

3. Accounts and Registration

To use certain features, you must create an account and provide accurate, complete information. We use email-based login codes or links to sign you in. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us promptly at info@mashahockey.com if you suspect unauthorized use. We may suspend or terminate accounts that contain false information or that are used in violation of these Terms.

4. The Services

The Services let you, among other things, view game schedules, RSVP to games, manage your participation and membership status, communicate with other members through in-app chat and messaging, and receive notifications. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use as a MASHA participant. We may add, change, suspend, or discontinue any part of the Services at any time.

5. Participation, Assumption of Risk, and Liability Waiver

Participation in street hockey and other MASHA activities involves inherent risks, including the risk of personal injury or death. Your use of the Services to register for or RSVP to activities is subject to MASHA’s Liability Waiver, which you accept during registration and which is incorporated into these Terms by reference. By RSVPing to or participating in any MASHA activity, you reaffirm your agreement to that Waiver.

6. Fees and Payments

Certain activities require payment, such as season/pass fees and per-game drop-in fees. Fees are described in the Services at the time of registration or RSVP.

Payments are processed by third-party payment providers (such as PayPal and Venmo). We do not collect or store your full payment card or bank account information; your use of those providers is governed by their own terms and privacy policies. You are responsible for paying all applicable fees through an approved method. Except where required by law, fees are non-refundable. We may correct any errors or inaccuracies in pricing even after a payment has been submitted.

7. User Conduct

You agree to use the Services lawfully and respectfully. You will not:

  • post content that is unlawful, harassing, abusive, threatening, defamatory, obscene, or hateful;
  • impersonate any person or misrepresent your affiliation;
  • harass, bully, or threaten other members;
  • post spam, advertising, or solicitations;
  • attempt to gain unauthorized access to the Services, other accounts, or our systems;
  • interfere with or disrupt the Services, or upload viruses or malicious code;
  • use the Services for any commercial purpose without our written permission; or
  • violate any applicable law or the rights of others.

We may remove content and suspend or terminate access for any violation of these Terms.

8. User Content

You are responsible for the content you post through the Services, including chat and messages (“User Content”). You retain ownership of your User Content, but you grant MASHA a non-exclusive, royalty-free, worldwide license to host, store, display, and distribute it as necessary to operate and provide the Services. You represent that you have the rights to post your User Content and that it does not violate these Terms or any law. We do not pre-screen User Content but may review, moderate, restrict, or remove it, and may restrict a member’s ability to post, at our discretion.

9. Notifications and Communications

By using the Services, you agree that we may send you administrative, transactional, and service-related communications, including push notifications and emails about games, schedules, payments, and your account. You can manage push notifications in your device settings or in the app, and you can opt out of marketing messages as described in our Privacy Policy.

10. Third-Party Services

The Services rely on and may link to third-party services (for example, our hosting and infrastructure provider, payment providers such as PayPal and Venmo, and notification providers). We are not responsible for the content, policies, or practices of third parties, and your use of their services is governed by their own terms.

11. Intellectual Property

The Services, including their software, design, text, graphics, logos, and the MASHA name and marks, are owned by MASHA or its licensors and are protected by intellectual property laws. Except for the limited license granted above, these Terms do not grant you any right to use our intellectual property without our prior written consent.

12. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that any information provided through the Services is accurate or complete. MASHA is a community organization, and the Services are provided to support league operations on a best-efforts basis.

13. Limitation of Liability

To the fullest extent permitted by law, MASHA and its board members, officers, volunteers, agents, and sponsors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or relating to your use of (or inability to use) the Services. To the fullest extent permitted by law, MASHA’s total liability for any claim arising out of or relating to the Services will not exceed the greater of the amount you paid to MASHA in the twelve (12) months before the claim, or US $100. Nothing in these Terms limits liability that cannot be limited under applicable law. This Section is in addition to, and does not limit, the Liability Waiver referenced in Section 5.

14. Indemnification

You agree to indemnify and hold harmless MASHA and its board members, officers, volunteers, agents, and sponsors from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or applicable law.

15. Termination

You may stop using the Services and delete your account at any time from within the app. We may suspend or terminate your access to the Services at any time, with or without notice, including for violation of these Terms. Sections that by their nature should survive termination (including Sections 5, 6, 8, and 11–14) will survive.

16. Changes to These Terms

We may modify these Terms from time to time. When we do, we will update the “Last updated” date above and post the revised Terms. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms. Please review this page periodically.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Gwinnett County, Georgia, and you consent to the jurisdiction of those courts.

18. Apple App Store Additional Terms

If you download our app from the Apple App Store, the following additional terms apply. These Terms are between you and MASHA only, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for any product warranties, claims, or third-party intellectual property claims relating to the app, or for addressing any claims relating to the app or your use of it (including product liability, legal/regulatory compliance, or consumer protection claims), except as required by law. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government restricted-party list. You must comply with applicable third-party agreements (for example, your wireless data agreement) when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
